{"id":1865,"date":"2025-05-09T10:52:50","date_gmt":"2025-05-09T14:52:50","guid":{"rendered":"https:\/\/regulacionconvergente.com\/?p=1865"},"modified":"2025-09-26T09:05:52","modified_gmt":"2025-09-26T12:05:52","slug":"la-gobernanza-de-plataformas-digitales-y-libertad-de-expresion-en-chile-un-debate-de-multiples-partes","status":"publish","type":"post","link":"https:\/\/regulacionconvergente.com\/english\/2025\/05\/09\/la-gobernanza-de-plataformas-digitales-y-libertad-de-expresion-en-chile-un-debate-de-multiples-partes\/","title":{"rendered":"Digital Platform Governance and Freedom of Expression in Chile: A Multi-Stakeholder Debate"},"content":{"rendered":"<h3 class=\"wp-block-heading\">In the context of the 32nd anniversary of World Press Freedom Day, Universidad de Chile and the UNESCO Office in Santiago presented the Guidelines for the Governance of Digital Platforms in the country, creating a space for reflection on the role of States, the civil society and platforms in disinformation and the protection of freedom of expression.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">On the morning of Tuesday, May 6th, the&nbsp;<strong>Transdisciplinary Digital Convergence Regulation Nucleus<\/strong>, the&nbsp;<strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/uchile.cl\/investigacion\/vicerrectoria\/vicerrector\" target=\"_blank\" rel=\"noreferrer noopener\">Research and Development Vice-Rectory of Universidad de Chile<\/a><\/span><\/strong>&nbsp;and the&nbsp;<strong><a href=\"https:\/\/www.isoc.cl\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span style=\"text-decoration: underline;\">Internet Society Chile Chapter<\/span><\/a><\/strong>, con el apoyo de la <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.unesco.org\/es\/fieldoffice\/santiago\" target=\"_blank\" rel=\"noreferrer noopener\">Oficina Regional de la&nbsp;UNESCO&nbsp;en Santiago<\/a><\/strong><\/span> and the&nbsp;<strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/fcei.uchile.cl\/\" target=\"_blank\" rel=\"noreferrer noopener\">Faculty of Communication and Image (FCEI)<\/a><\/span> de la <span style=\"text-decoration: underline;\"><a href=\"https:\/\/uchile.cl\/\" target=\"_blank\" rel=\"noreferrer noopener\">Universidad de Chile<\/a><\/span><\/strong>, commemorated the 32nd anniversary of&nbsp;<strong>World Press Freedom Day<\/strong>&nbsp;at the Elo\u00edsa D\u00edaz Hall of our Central House with the event&nbsp;<strong><em><a href=\"https:\/\/www.unesco.org\/es\/articles\/seminario-gobernanza-de-plataformas-digitales-y-nuevos-desafios-para-la-libertad-de-expresion?hub=66920\" target=\"_blank\" rel=\"noreferrer noopener\"><span style=\"text-decoration: underline;\">Digital Platform Governance and New Challenges for Freedom of Expression<\/span><\/a><\/em><\/strong>. The activity was conducted one year after our country hosted the international ceremony, which this year was held in Brussels, Belgium.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the topic of this version of the international UNESCO conference was&nbsp;<strong>generative artificial intelligence and journalism<\/strong>, the academics that organized this event decided it was not possible to talk about this without first posing the question of&nbsp;<strong>platform governance<\/strong>, a concept that was explained by the&nbsp;<strong>FCEI academic and director of the Transdisciplinary Digital Convergence Regulation Nucleus<\/strong>,&nbsp;<strong><a href=\"https:\/\/fcei.uchile.cl\/facultad\/estructura\/cuerpo-academico\/chiara-saez-baeza\" target=\"_blank\" rel=\"noreferrer noopener\"><span style=\"text-decoration: underline;\">Chiara S\u00e1ez<\/span><\/a><\/strong>: \u201cWe always talk about&nbsp;<strong>governance&nbsp;<\/strong>as the&nbsp;<strong>regulation of different levels<\/strong>&nbsp;, where various actors with varying capacity for interference participate. There are two very important ones: the&nbsp;<strong>platforms<\/strong>&nbsp;themselves and the&nbsp;<strong>States<\/strong>. The&nbsp;<strong>lack of transparency of algorithms, automated biases, the concentration of digital power, threats to information diversity and fundamental rights&nbsp;<\/strong>are of great concern to us. And I would like to open a small parenthesis here. When we speak of biases (\u2026) online&nbsp;<strong>, the existing information is based on more or less 100 languages<\/strong>,&nbsp;<strong>, but there are over seven thousand languages in the world<\/strong>. Its purpose is to safeguard freedom of expression and information access rights while addressing&nbsp;<strong>disinformation, hate speech and conspiracy theories<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presentation was mediated by academic&nbsp;<strong>Chiara S\u00e1ez<\/strong>, who guided it and asked expert Ana Cristina Ruelas how Latin American countries can aim at governance with a regionalist perspective. Yet the same digital platforms that have democratized access to knowledge and culture, and fostered global connection, have also become ecosystems of misinformation, disinformation, ideological polarization, and incitement to violence, discrimination, and hate. Such features have undermined democracies and threatened human rights across the world,\u201d stated UNESCO in the original presentation of the document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El proceso para llegar a estas propuestas se inici\u00f3\u00a0el 2022 a partir de un di\u00e1logo mundial sobre regulaci\u00f3n de plataformas digitales. En noviembre de 2023, la UNESCO public\u00f3 las Directrices tras tres consultas abiertas, m\u00e1s de 10.000 comentarios y la participaci\u00f3n de personas de 134 pa\u00edses, resaltando la necesidad de mecanismos de gobernanza abiertos y con la participaci\u00f3n de <strong>multiple stakeholders<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">UNESCO suggests that all stakeholders share the responsibility of maintaining a favorable environment for freedom of expression and the right to information while also ensuring an open and safe environment for users and non-users. The Guidelines describe a set of duties, responsibilities and roles for States, digital platforms, intergovernmental organizations, the civil society, media, the academic world, the technical community and other stakeholders to create an environment in which freedom of expression and information are at the center of the governance processes of digital platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also promotes media literacy as an essential tool for empowering citizens and strengthening resilience in the face of harmful contents circulating online, in addition to underlining the importance of proportionate, responsible and collaborative regulations in which platforms must be held accountable, adjust their algorithms to human rights standards and promote media and information literacy, particularly among more vulnerable groups.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Present and Future Challenges of Digital Platforms<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The second part of the event focused on the panel discussion&nbsp;<em><strong>\u201cPresent and Future Challenges for the Governance of Digital Platforms in Chile\u201d<\/strong><\/em>\u201d, which was moderated by the&nbsp;<strong>FCEI academic and alternate director of the Transdisciplinary Digital Convergence Regulation Nucleus<\/strong>,&nbsp;<strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/fcei.uchile.cl\/facultad\/estructura\/cuerpo-academico\/patricia-pena-miranda\" target=\"_blank\" rel=\"noreferrer noopener\">Patricia Pe\u00f1a,<\/a><\/span><\/strong>. The panel had several members: the attorney and president of the National Television Council,&nbsp;<strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/cntv.cl\/acerca-del-cntv\/quienes-son-los-consejeros\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mauricio Mu\u00f1oz<\/a><\/span><\/strong>; the academic at the Faculty of Government of Universidad de Chile and member of the Electoral Service\u2019s board,&nbsp;<strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/uchile.cl\/noticias\/183895\/profesora-maria-cristina-escudero-es-nombrada-consejera-del-servel\" target=\"_blank\" rel=\"noreferrer noopener\">Mar\u00eda Cristina Escudero<\/a><\/span><\/strong>; the journalist and researcher at the Observatory of the Right to Communication,&nbsp;<strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.linkedin.com\/in\/jorge-avil%C3%A9s-rojas-672b0a224\/?originalSubdomain=cl\" target=\"_blank\" rel=\"noreferrer noopener\">Jorge Avil\u00e9s<\/a><\/span><\/strong>; and the psychologist and researcher at the Center for Advanced Research in Education (CIAE) of Universidad de Chile,&nbsp;<strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/ciae.uchile.cl\/perfil\/patricio-cabello\" target=\"_blank\" rel=\"noreferrer noopener\">Patricio Cabello<\/a><\/span><\/strong>. Gobierno Uchile; Patricia Pe\u00f1a, FCEI Uchile, Chiara S\u00e1ez, FCEI Uchile; Mauricio Mu\u00f1oz, presidente CNTV; Jorge Avil\u00e9s, ODC Chile.<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">At the end of the day, the academic at the Faculty of Communication and Image,&nbsp;<strong>Patricia Pe\u00f1a,<\/strong>referred specifically to the&nbsp;<strong>challenges we are currently facing in Chile&nbsp;<em>on the verge<\/em>&nbsp;of the executive and legislative<\/strong>&nbsp;elections: \u201cDuring electoral times, what we have seen globally, and this has been a warning for the past two years, is that&nbsp;<strong>we will see more and more information circulating that is manipulated or altered in some way by generative artificial intelligence<\/strong>. For example, a video of a candidate saying something that, strictly speaking, they never said. Today&nbsp;<strong>this is not necessarily regulated on digital platforms, which, let\u2019s not forget, are companies<\/strong>.\"<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Operationalization of the Guidelines in Chile<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the Chilean context, the Transdisciplinary Digital Convergence Regulation Nucleus, a project born under the auspices of the Research and Development Vice-Rectory of Universidad de Chile, has started to translate these guidelines into the local reality with a particular emphasis on the protection of children, marginalized communities, journalists and electoral processes. The research, led by FCEI academics Chiara S\u00e1ez and Patricia Pe\u00f1a, reveals the need for a convergent institutionalism and regulatory capacities with democratic legitimacy.
