The same sentence is heard over and over in meeting spaces fostered by technology industries: regulation makes innovation difficult. But what is the genealogy of this statement and its foundation in the Latin American context?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its origin is closely connected with the approach of the current US administration, which has undertaken a liberalization of its regulation in the sector linked to artificial intelligence, in addition to pointing out to the European Union that its regulations have hampered Europe\u2019s technological progress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a recent article entitled \u201cThe False Choice Between Digital Regulation and Innovation\u201d, Columbia University academic Anu Bradford argues that although the United States has a competitive advantage over the EU in the digital industry, the technological gap is not due to the latter\u2019s strict digital regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bradford offers alternative explanations and explores how policymakers should reevaluate the relationship between digital regulations and innovation. The author claims that while the US model reflects a cultural commitment to the concept of free market and skepticism about government regulation, the European Union has adopted a rights-driven regulatory model in which the protection of fundamental rights shapes its regulatory design. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Interesting innovations have taken place in this context precisely to protect the users, such as an application developed by Apple -in response to the EU\u2019s data protection regulations- that allows controlling whether applications such as Instagram and TikTok can track their online activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En este escenario, el espacio regional latinoamericano presenta algunas particularidades, siendo una de ellas la alianza p\u00fablico &#8211; privada en materia de desarrollo tecnol\u00f3gico, por lo que a diferencia del modelo norteamericano basado en capital de riesgo o el europeo basado en los bancos, en nuestra regi\u00f3n es m\u00e1s com\u00fan el subsidio p\u00fablico a iniciativas privadas.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a significant presence of the State in our context and, therefore, policymakers should consider a greater guarantee of protection of citizens and their rights, even when they think of them only as users or consumers. Another important element is the size of our countries and the need for regionally articulated regulations, for instance, regarding digital platforms.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On this point, both the Advanced Framework Agreement between Chile and the European Union and the EU-LAC Digital Alliance are spaces for deepening knowledge and transfer of regional best practices based on the EU. Let\u2019s not forget that this alliance originally had three pillars: connectivity, cybersecurity and a rights perspective that allows advancing a digitalization that safeguards democratic values and principles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the specific case of the EU-Chile Advanced Framework Agreement, it is already in its provisional application phase. Chapter 5 contains at least two articles that should be examined with interest for the discussion of future regulations at a Latin American level but in which Chile may have the edge due to the closer relationship arising from this agreement, namely concerning cooperation in relation to the UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions in the audiovisual field and cooperation on audiovisual diversity in the context of emerging and new technologies (Article 5.7), and regarding the exchange of views on different aspects of the European Union\u2019s Digital Single Market Strategy, particularly policies and regulation of electronic communications, the exchange of perspectives on the independence of regulatory authorities in charge of digital policy, the exchange of perceptions on the promotion of a free and open Internet, and the promotion of digital competencies (Article 5.10).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is necessary to open the discussion on how to better move forward with regulations that enable innovation and respect for various rights in the digital domain. But it must be done in a serious manner based on evidence and our own regional and national reality.
